Terms of Service

These Terms of Service ("Terms") set out the conditions for using the vacant-home trial-stay and purchase-consultation platform "AkiyaWay" ("the Service") provided by Junji Nitasaka (trade name: Amami, "we"). Users use the Service after agreeing to these Terms.

Article 1 (Application)

These Terms apply to all relationships between us and users concerning the use of the Service.

Article 2 (Definitions)

The main terms used in these Terms have the following meanings.

  • "Trial stay (experience stay)" means a service that allows you to stay in a listed property free of charge to experience the living environment.
  • "Trial Stay Gear Pack" means physical goods that provide, for a fee, bedding and daily-living items needed for a trial stay.
  • "Purchase consultation" means consultation and provision of information regarding the purchase of a listed property.
  • "Member" means a user who has agreed to these Terms and completed registration.

Article 3 (Member Registration)

Some features of the Service require member registration. Users must register true and accurate information and must not register false information. If we determine that registration is inappropriate, we may refuse or cancel it.

Article 4 (Account Management)

Members are responsible for managing their own email address and password. If you discover unauthorized use by a third party, please contact us promptly. Members bear responsibility for damage arising from inadequate account management.

Article 5 (Trial-Stay Bookings)

Trial stays (experience stays) are provided free of charge. A booking is established upon the owner's approval. Members must comply with the rules of the property and the local area and stay with the care of a prudent manager. The smart-lock one-time PIN is valid only for the stay period and must not be disclosed to third parties.

Article 6 (Purchase of Gear Packs and Other Goods)

Members may purchase physical goods such as Trial Stay Gear Packs on the Service. A purchase contract is established when we confirm completion of payment. Sales conditions, returns, exchanges, and the like follow the "Notice Based on the Act on Specified Commercial Transactions".

Article 7 (Fees and Payment Methods)

Fees for paid goods are displayed, tax included, on each product page. Payment is made by credit card (Stripe), and payment information is processed by Stripe. We do not retain credit card numbers.

Article 8 (Purchase Consultation)

Purchase consultation is intended to provide information and does not guarantee the conclusion of a property sale contract. The content and conditions of any sale contract are agreed separately between the seller and the relevant licensed real estate broker.

Article 9 (Prohibited Conduct)

In using the Service, users must not engage in the following acts.

  • Acts that violate laws or public order and morals
  • Acts that infringe the rights or interests of us or third parties
  • Registering or posting false information
  • Acts that interfere with the operation of the Service, or unauthorized access
  • Improperly providing smart-lock PINs and the like to third parties
  • Using the Service for unauthorized reproduction, scraping, and similar activities

Article 10 (Suspension and Interruption of the Service)

We may suspend or interrupt all or part of the Service without prior notice where there are unavoidable reasons such as system maintenance, natural disasters, or failures of communication lines. We bear no responsibility for damage arising to users as a result.

Article 11 (Intellectual Property Rights)

Intellectual property rights relating to the Service and the content it contains (text, images, logos, programs, etc.) belong to us or to the rightful holders. Users must not reproduce or divert them without the rights holder's permission.

Article 12 (Disclaimer)

We do not warrant, expressly or impliedly, that the Service is free of factual or legal defects. While we make reasonable efforts regarding the accuracy and completeness of listed information, final verification of property and area information is the user's responsibility. Except in cases of our willful misconduct or gross negligence, we bear no responsibility for damage arising to users in connection with the Service.

Article 13 (Changes to and Termination of the Service)

We may change the content of the Service or terminate its provision upon prior notice to users.

Article 14 (Changes to the Terms)

We may change these Terms when we deem it necessary. The revised Terms take effect from the time they are displayed on the Service.

Article 15 (Governing Law and Jurisdiction)

Japanese law governs the interpretation of these Terms and the use of the Service. In the event of a dispute concerning the Service, the court having jurisdiction over our location shall be the exclusive agreed jurisdiction of first instance.
